Introduction

These Terms of Use form a legally binding agreement between you and Mascot Techcrib Private Limited (trading as EduCrib) governing your access to and use of https://www.educrib.com and all associated applications.

They should be read alongside our Privacy Policy, Content Ownership & IP Policy, and Data Security policy.

1. Overview & Acceptance

This website at https://www.educrib.com and its associated mobile and desktop applications (collectively, the "Platform") is owned and operated by Mascot Techcrib Private Limited (trading as EduCrib) ("we," "us," "our," or "EduCrib").

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "You") and EduCrib, governing your access to and use of the Platform and all services available through it. These Terms must be read together with our Privacy Policy, which is incorporated herein by reference.

By visiting, registering on, or using any part of the Platform — including browsing listings, submitting enquiry forms, posting reviews, or accessing any content — you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use this Platform.

These Terms are binding upon you and your heirs, representatives, successors, and assigns, as applicable. Additional product-specific terms may apply to certain services and will be communicated at the relevant point of use.

2. Eligibility

By accessing or using the Platform, you represent and warrant that:

• You are competent to enter into a valid, binding contract under applicable law
• You are at least 18 years of age, OR you are using the Platform under the direct supervision of a parent, legal guardian, or responsible adult who accepts these Terms on your behalf
• If you are a parent or guardian submitting an admission enquiry on behalf of a minor child, you have full authority to do so and consent to these Terms on the minor's behalf
• You are not barred from receiving services under the laws of India or any other applicable jurisdiction
• You are not purchasing or accessing our services for resale to others without EduCrib's prior written consent

3. Purpose of the Platform

EduCrib is an education discovery and connection platform made available to help students, parents, and guardians across India to:

• Search, discover, compare, and shortlist colleges, schools, playschools, coaching institutes, tutors, and educational consultants
• Access information on courses, admission processes, fees, reviews, scholarships, events, and hostels
• Submit admission enquiries to listed institutions and service providers
• Apply for internships and jobs in the education sector
• Access educational articles, guides, and platform-curated content

EduCrib also connects educational institutions, tutors, and service providers ("Listing Partners") with prospective students and parents who may be interested in their offerings.

EduCrib does not take applications or registrations on behalf of any college or institution. By applying to any institution through the Platform, the user is seeking EduCrib's assistance in the enquiry process — not a direct application to that institution. The institution's own admissions process governs the outcome.

4. Registration & Account

4.1 Account Creation

Certain features of the Platform require you to register and create an account. When registering, you agree to:

• Provide accurate, current, and complete information including your name, email address, and phone number
• Keep your account information updated at all times — incorrect or false details may result in termination of services
• Maintain the confidentiality of your login credentials; you are solely responsible for all activity conducted under your account
• Notify EduCrib immediately at [email protected] if you suspect any unauthorised access to your account

4.2 Account on Registration — Contact Consent

By creating an account on EduCrib, you agree that EduCrib may use your contact details for account administration, transactional communication, and service delivery. Your contact details shall be shared with listing partners where you have provided consent or submitted a specific enquiry intended for such listing partner. You may be contacted by EduCrib or its partners for additional information, course guidance, admission updates, and related educational services through email, telephone, SMS, and WhatsApp.

If you do not wish to be contacted for promotional purposes, you may modify your communication preferences in your Account Settings or by contacting us at [email protected]. See Section 16 for full opt-out options.

4.3 Account Security & Responsibility

You are fully responsible for all activities that occur under your account. EduCrib presumes that all activity through a user account is authorised by the account holder. EduCrib shall not be liable for any loss or damage arising from your failure to maintain the confidentiality of your credentials.

5. Consent to Be Contacted (TRAI / DLT Compliance)

Consent to receive promotional or admission-related communications by phone call, SMS, WhatsApp, or email shall be obtained through an opt-in mechanism, and an explicit opt-out mechanism shall be provided. Communications may be received from EduCrib and from educational institutions, tutors, and service providers to whom your enquiry has been forwarded, via:

You understand and agree that this consent applies even if your mobile number is registered under the Do Not Disturb (DND), Do Not Call (DNC), or National Customer Preference Register (NCPR) list, as permitted under applicable TRAI regulations and the Telecom Commercial Communications Customer Preference Regulations, 2018 (TCCCPR), provided such consent is recorded and maintained in accordance with the Distributed Ledger Technology (DLT) framework mandated by TRAI.

This consent shall remain valid for a period of 365 days from the date of your registration or last interaction with the Platform (whichever is later). You may withdraw this consent at any time by contacting us at [email protected] or by adjusting your preferences in Account Settings. See Section 16 for full opt-out options.

6. Use of the Platform

The Platform and all services available through it are intended exclusively for lawful purposes consistent with the Purpose defined in Section 3, and for your personal, non-commercial use only, unless you are a registered Listing Partner using the Platform in your professional capacity.

You agree to use the Platform only in a manner that:

• Complies with all applicable Indian laws and regulations, including the Information Technology Act, 2000, DPDP Act, 2023, TCCCPR, 2018, and the Indian Penal Code
• Respects the rights and privacy of other users and third parties
• Does not harm, disrupt, or degrade the performance of the Platform or its infrastructure
• Does not misrepresent your identity, qualifications, or affiliation

The Platform contains links to third-party websites and applications. These links are provided for convenience only. EduCrib does not endorse or take responsibility for the content, accuracy, or practices of any third-party site. You access third-party sites entirely at your own risk.

7. Prohibited Uses

The following actions are strictly prohibited on EduCrib and constitute a misuse of the Platform. EduCrib reserves the right to immediately suspend or terminate access without notice for any of the following:

7.1 Data & Content Misuse

• Copying, extracting, scraping, downloading, storing, distributing, or selling any content, data, profiles, photographs, or listings from the Platform without EduCrib's prior written consent
• Using automated tools, bots, spiders, crawlers, browser extensions, or similar programs to access, navigate, or extract data from the Platform
• Reverse engineering, decompiling, or attempting to derive source code from any part of the Platform
• Framing, mirroring, or reproducing the Platform or any part of it on any other website or application without permission

7.2 Security & Integrity Violations

• Attempting to gain unauthorised access to any part of the Platform, its servers, or any other user's account
• Probing, scanning, or testing the vulnerability of EduCrib's systems or networks
• Circumventing any security, authentication, or access control measures on the Platform
• Uploading or transmitting malware, viruses, ransomware, or any other malicious code

7.3 Content Violations

• Posting false, misleading, defamatory, or fraudulent content — including fake reviews, fabricated rankings, or false accreditation claims
• Impersonating any person, institution, government body, or EduCrib
• Uploading content that is obscene, pornographic, hateful, harassing, discriminatory, or harmful to minors
• Posting content that violates the intellectual property rights of any third party
• Spam, phishing, or any form of unsolicited commercial communication directed at other users

7.4 Commercial Misuse

• Using EduCrib data or listings to build a competing product or service without prior written consent
• Reselling access to the Platform or its data to third parties
• Using the Platform to conduct any activity that is illegal under Indian law, including unlicensed educational services or fraudulent fee collection

8. User Content & Reviews

8.1 Your Content

EduCrib allows users to submit reviews, ratings, questions, answers, comments, and other content ("User Content"). By submitting User Content, you represent that:

• The content is based on your honest, genuine personal experience
• The content does not infringe any third-party intellectual property, privacy, or other rights
• The content does not contain false, defamatory, offensive, or illegal material

8.2 License to EduCrib

By submitting User Content, you grant EduCrib a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, publish, translate, and distribute your content across the Platform and EduCrib's marketing channels, including newsletters and social media, with attribution where appropriate. You retain ownership of your content.

8.3 Review Policy

EduCrib's review policy ensures that student reviews reflect honest personal experiences. Where incentives are offered for submitting reviews, they are provided for participation only — not for favourable opinions. EduCrib moderates all reviews for quality, accuracy, and compliance with applicable data privacy and consumer protection laws.

EduCrib reserves the right to remove any User Content that violates these Terms, is reported as false or misleading, or is otherwise deemed inappropriate, at its sole discretion and without prior notice.

8.4 Testimonials

Users who provide testimonials consent to their public display on the Platform and, where relevant, their sharing with EduCrib's partner institutions for promotional purposes. EduCrib will not use testimonials in a manner that misrepresents the user's original intent.

9. Institution & Partner Listings

9.1 Accuracy of Listings

EduCrib aggregates and displays information about educational institutions, tutors, consultants, and service providers from publicly available sources and directly from listing partners. While we make reasonable efforts to ensure accuracy, EduCrib does not independently verify all listing information and cannot guarantee its completeness, currency, or accuracy.

EduCrib is neither affiliated with nor endorsed by any government organisation, the UGC, AICTE, or any state or central education board. Information about institutions and examinations is sourced from official websites and updated regularly, but EduCrib assumes no liability for errors or omissions.

9.2 No Guarantee of Outcomes

EduCrib does not guarantee admission to any institution, employment, scholarship awards, or any other educational outcome. The decision to admit, hire, or award scholarships rests entirely with the relevant institution or body. EduCrib's role is limited to facilitating discovery and connection.

9.3 Listing Partner Obligations

Institutions, tutors, and consultants listing their services on EduCrib agree to provide only accurate, non-misleading information and to comply with all applicable laws and EduCrib's Content Standards. EduCrib reserves the right to remove or suspend any listing that violates these obligations. See EduCrib's Content Ownership & IP Policy for full partner obligations.

10. Intellectual Property Rights

10A. EduCrib Functions as an Intermediary

EduCrib functions as an intermediary within the meaning of Section 2(1)(w) of the Information Technology Act, 2000. EduCrib is not the originator of third-party content, institutional listings, reviews, or partner articles published on the Platform. Accordingly, EduCrib claims the safe harbour protection available under Section 79 of the IT Act and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, as amended, in respect of all third-party content, provided EduCrib has complied with its due diligence obligations under such Rules.

10.1 EduCrib's IP

Unless otherwise stated, Mascot Techcrib Private Limited (trading as EduCrib) holds all intellectual property rights in and to the Platform, including its design, layout, software, source code, algorithms, logos, brand identity, images, text, and all other content produced by EduCrib ("EduCrib Content"). These rights are protected under Indian copyright law, the Trade Marks Act, 1999, and applicable international treaties.

No part of EduCrib Content — including logos, graphics, data, or platform structure — may be copied, reproduced, distributed, republished, scraped, or commercially exploited without EduCrib's prior express written permission.

10.2 Limited User Licence

EduCrib grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial purposes only, in accordance with these Terms. This licence does not include the right to sub-licence, sell, or commercially exploit any EduCrib Content.

10.3 Reporting IP Infringement

If you believe your intellectual property has been infringed on the Platform, please contact us at [email protected] with a description of the work, a link to the infringing content, your contact details, and a good-faith statement. EduCrib will investigate and respond within 14 business days.

11. Third-Party Links & Services

The Platform may contain links to third-party websites, applications, and services — including partner institutions, advertisers, social networks, and external tools. EduCrib provides these links for convenience only and does not endorse, control, or take responsibility for:

• The accuracy, completeness, or legality of content on third-party sites
• Any damage caused by software downloaded from linked sites
• The privacy practices or data handling of third-party sites

This Terms of Use does not apply to third-party sites. You access them entirely at your own risk and should review their respective terms and privacy policies before sharing any personal information.

12. Disclaimer of Warranties

EduCrib does not warrant that:

• The Platform will be available at all times or free from errors, interruptions, or security breaches
• Any information or listing on the Platform is accurate, complete, current, or suitable for your purposes
• Results obtained from the use of the Platform (including admission outcomes) will be accurate or reliable
• Any defects in the Platform will be corrected

EduCrib reserves the right to modify, suspend, or discontinue the Platform or any feature thereof at any time without notice. EduCrib shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

13. Limitation of Liability

To the maximum extent permitted by applicable Indian law, Mascot Techcrib Private Limited (trading as EduCrib), its directors, officers, employees, affiliates, agents, contractors, and licensors shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages — including lost profits, loss of data, loss of goodwill, or reputational harm — arising from:

• Your use of or inability to use the Platform
• Any content, information, or listings on the Platform
• Any admission decisions, outcomes, or transactions made through or in connection with the Platform
• Unauthorised access to or alteration of your data
• Any conduct or content of any third party on the Platform

EduCrib is not liable for any loss or damage arising from inadvertent disclosure of account information or financial details. EduCrib does not store credit card, debit card, or UPI credentials.

14. Indemnification

You agree to indemnify, defend, and hold harmless Mascot Techcrib Private Limited (trading as EduCrib), its parent, subsidiaries, affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use of or access to the Platform
• Your breach of these Terms or any applicable law
• Any User Content you submit, post, or transmit through the Platform
• Your violation of the rights of any third party, including intellectual property, privacy, or consumer rights
• Any misrepresentation made by you in connection with your use of the Platform

EduCrib's right to indemnification from a user under this Section shall not be interpreted to waive any right EduCrib may have under applicable law, and nothing in this Section shall require EduCrib to seek indemnification as a precondition to any other remedy.

15. Payment Terms

Certain services on EduCrib — including paid institutional profiles, premium listing features, and advisory services — require payment. By making a payment through the Platform, you agree that:

• All payments are processed by PCI-DSS-compliant third-party payment gateways (such as Razorpay or PayU). EduCrib does not store credit card, debit card, or UPI details
• Prices for paid services are subject to change without notice
• EduCrib reserves the right to refuse, cancel, or limit any order at its sole discretion
• Billing information you provide must be current, complete, and accurate
• You are responsible for any applicable taxes arising from your purchase

For refunds and cancellations, please refer to EduCrib's Refund & Cancellation Policy, available on the Platform. Until the formal policy is published, the interim framework in EduCrib's Education Support Policy applies.

16. Opt-Out of Communications

You have the right to opt out of promotional communications from EduCrib at any time. Please note that even after opting out of promotional messages, you will continue to receive essential transactional communications such as OTP verifications, account alerts, and legal notices.

EduCrib shall process opt-out and consent withdrawal requests as soon as reasonably practicable and, in any event, within 72 hours for EduCrib-originated communications, subject to technical processing constraints. For communications initiated by third-party institutions based on previously shared lead data, EduCrib shall notify the concerned institution without undue delay and record the withdrawal in its lead-sharing records.

17. Termination & Suspension

17.1 By EduCrib

EduCrib reserves the right to suspend or terminate your access to the Platform — with or without notice — at any time, for reasons including but not limited to:

• Breach of these Terms or any applicable law
• Fraudulent, abusive, or harmful conduct on the Platform
• Providing false information during registration or enquiry submission
• Any activity that EduCrib reasonably believes poses a risk to the Platform, other users, or third parties

Obligations and liabilities incurred prior to termination shall survive the termination of these Terms.

17.2 By You

You may terminate your account at any time by visiting your Account Settings and selecting "Delete Account," or by contacting us at [email protected]. Upon termination, your public content may be removed from view, though certain data may be retained as required by law or for legitimate business purposes as described in our Privacy Policy.

18. Governing Law & Dispute Resolution

These Terms of Use and all matters arising from or related to your use of the Platform shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any dispute, controversy, or claim arising from these Terms — including their formation, validity, breach, or termination — shall first be attempted to be resolved through good-faith negotiation by contacting EduCrib at [email protected]. If the dispute is not resolved within 30 days, it shall be subject to the exclusive jurisdiction of the competent courts located in Kerala, India.

Prior to initiating any legal proceedings, the parties agree to attempt resolution of the dispute through good-faith mediation conducted under the Mediation Act, 2023, within a period of 30 days from the date of formal written notice. This clause shall not prevent either party from seeking urgent interim relief from a court of competent jurisdiction.

19. Amendments

EduCrib reserves the right to update, change, or replace any part of these Terms of Use at any time by posting the revised version on this page with an updated effective date. For material changes, registered users will be notified via email at least 14 days before the changes take effect.

It is your responsibility to check these Terms periodically for changes. Your continued use of the Platform following the posting of any changes constitutes your acceptance of those changes.

20. Miscellaneous

• Entire Agreement: These Terms, together with the Privacy Policy, Data Privacy & Security Policy, Content Ownership & Intellectual Property Policy, Education Support Policy, and Cookie Policy, each as amended from time to time, constitute the entire agreement between you and EduCrib with respect to your use of the Platform.
• Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, it shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.
• No Waiver: EduCrib's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
• Assignment: You may not assign or transfer your rights or obligations under these Terms without EduCrib's prior written consent. EduCrib may assign its rights and obligations freely, including in connection with a merger, acquisition, or sale of assets.
• Force Majeure: EduCrib shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including acts of God, natural disasters, government actions, strikes, or internet outages.
• Language: These Terms are written in English. In case of any conflict between an English version and a translated version, the English version shall prevail.
• Service Suspension: Response time commitments and service delivery obligations shall be suspended during, and for a reasonable period following, any event outside EduCrib's reasonable control, including cloud hosting outages, cyber attacks, DDoS events, force majeure events, government-directed platform restrictions, or interruptions to third-party infrastructure providers.
